A proposed class action settlement has been reached between CertainTeed Corporation and representatives of owners of buildings on which the Siding had been installed. The settlement is intended to resolve disputes between the parties about the performance of the Siding. This proposed class action settlement covers the entire United States. Although the Court has not yet decided whether to approve this settlement, CertainTeed has agreed to pay $103.9 million to settle the class action.
On March 8, 2013, Certainteed Corporation filed an answer to Plaintiff's class action complaint that included affirmative defenses. We are currently awaiting a Scheduling Conference to set forth a timeline for discovery and dispositive motinos. No additional action has been taken.

Minnesota resident Monique Orieux has filed a class action lawsuit against CertainTeed Corporation alleging that the company's WeatherBoards fibercement siding is defectivly designed. The lawsuit alleges that the defective design causes the WeatherBoards siding to crack, warp, discolor, shrink, and in some cases fall off the building. Ms. Orieux is seeking monetary compensation, on behalf of herself and others in a similar situation, to replace her defective siding as well as a court order requiring CertainTeed to honor its warranty obligations.
